New Opening Up Copyright Module: Insubstantial Copying

Copyright Office - 6 October 2025

Did you know that insubstantial parts of works do not fall under copyright protection? The Copyright Act grants the creator of a work the "sole right to produce or reproduce the work or any substantial part thereof in any material form whatever." (s. 3(1)) [emphasis added]

Therefore, users have the right to copy insubstantial portions of copyright-protected works without seeking permission. Determining how much of a work is an insubstantial portion, however, is a matter of interpretation. Our new OUC Module on is a short, interactive video that will help you learn about assessing substantiality.
